1. What Information is Collected and Processed

If an organization with which you are associated purchases products and services from LinkSquares under an agreement (the “TOS”), LinkSquares may receive personal information about you in connection with LinkSquares’ provision of such products and services to such organization (“Client Personal Data”). LinkSquares processes Client Personal Data on behalf of and under the instruction of the respective organization in accordance with the TOS by and between LinkSquares and LinkSquares’ customers (a “Client”). This Privacy Policy does not explain how LinkSquares and LinkSquares Clients collect, use, and disclose Client Personal Data. That is determined by LinkSquares Clients. You should review LinkSquares Clients’ privacy statements or ask them to explain their privacy practices surrounding the collection, use, and disclosure of Client Personal Data.

  • LinkSquares may collect the following types of personal information:
    • Personal Information Provided to LinkSquares. LinkSquares will have access to any personal information you provide to LinkSquares through web forms or by otherwise interacting with the LinkSquares Website or LinkSquares Activities, such as by signing up for a webinar, subscribing to LinkSquares’ blog, or messaging with one of LinkSquares’ agents via the “chat'' on the LinkSquares Website. Such personal information may include your email address, first and last name, job title, and other business information.
    • Networking Activities. LinkSquares may collect your personal information as part of networking activities, such as when you register for an event hosted or sponsored by LinkSquares or meet with a LinkSquares representative at a business conference. LinkSquares may receive personal information you have shared with third parties from such third parties as part of networking activities. Webinars, in-person events, or other similar events that you participate in with LinkSquares may be photographed or recorded.
    • Surveys, Sweepstakes and Promotions. You may share personal information with LinkSquares as part of participating in surveys, sweepstakes, or other promotions. Participation is voluntary and may be subject to additional terms.
    • Customer Reviews. LinkSquares may receive your personal information if you participate in customer testimonials and reviews, which may include personal information. This may include personal information received from testimonials and/or reviews you participated in with third-party providers or on third-party platforms.
    • Communications. LinkSquares may receive personal information from you through your interaction with phone, SMS, or email communications, such as when you open an email or click a link in an email. Calls held with LinkSquares’ representatives may be recorded, monitored, and transcribed.
    • Prospective Employees, Employees, and Contractors. LinkSquares collects personal information from you when you apply for employment with LinkSquares, such as the information contained in your resume and employment application.
      • If you are hired as an employee, LinkSquares collects information related to your employment and to comply with applicable laws, including to provide any employment benefits as applicable. This may include, without limitation, your photograph, signature, telephone number, passport number, driver’s license, insurance policy number, bank account number, age, gender, marital status, or military status.
      • Individuals retained as independent contractors or service providers may provide information related to the engagement, such as your name, business address, email and telephone number, and any other information related to your engagement.
  • Cookies and Similar Technologies. LinkSquares may collect information about your online activity through the LinkSquares Activities (such as via the LinkSquares Website), access to the LinkSquares products and/or services, and other websites or sites that reference or link to this Privacy Policy. LinkSquares gathers data such as your Internet Protocol (IP) address, cookies, pixels, and action tags, device information (including unique device identifier, device IMEI, device type, operating system and platform, and other technology on the devices used to access or interact with the LinkSquares Activities), language, the country you are located in, browser details, website user marketing and communication preferences, requested URL, referring URL, the pages viewed and date and time of your visit, time-zone setting and location, username, screen dimensions, location data, browser language, and other similar technologies and user preferences that are assigned to your computer or devices.
  • Log Files. LinkSquares also collects and processes information that your browser sends whenever you visit the LinkSquares Website, use LinkSquares’ products or services, or engage with any LinkSquares Activities, such as through Internet log files. This may include information such as user IP addresses, other addressing information, the time spent on pages visited, browser types, domain names, internet service provider (ISP), the files viewed, your operating system, access dates and times, referring website addresses, and other statistics or information that is automatically transmitted when making connections over the Internet. When you interact with the LinkSquares Activities via a mobile device, we may collect additional information such as the type of mobile device used, your mobile device’s unique device ID, the IP address of your mobile device, your mobile device operating system, the type of mobile internet browser you use, and your general location information.
  • Third Party Integrations. If you connect your LinkSquares account to a third-party provider through an integration, such as with another SaaS provider, you may be granting permission for LinkSquares to share information with, or receive information from, such a third-party system. LinkSquares may collect information related to what integrations are enabled in your LinkSquares account. LinkSquares is not responsible for any third-party provider or integration with a third-party system, and you should review the permissions granted to such third-party systems in detail before connecting the third-party system through an integration.
  • Third Parties. LinkSquares may receive information, including personal information, about you from third parties, including without limitation partners as part of co-marketing partnerships and relationships and third-party service providers providing LinkSquares with data aggregation, analytics, lead generation, or other services. LinkSquares may also collect personal information about you from publicly available sources, such as LinkedIn.

2. How Your Personal Information is Used

LinkSquares uses information, including personal information, for the following purposes:

  • Providing you with products and services, and any associated support services and technical support, pursuant to a contract that LinkSquares has or is about to enter into with you, and for LinkSquares’ business operations;
  • Analyzing trends, and administering and monitoring the LinkSquares Activities (and without limitation, the LinkSquares Website);
  • Testing, monitoring, diagnosing, and fixing issues, such as issues with the LinkSquares products and services and LinkSquares Activities;
  • Communicating with you, such as informing you of upcoming events, responding to questions or communications you send to LinkSquares, or sharing information that LinkSquares determines may be of interest to you;
  • Improving, understanding, developing and personalizing LinkSquares advertising, marketing, and promotional activities and LinkSquares products and services, including the LinkSquares Activities (and without limitation the LinkSquares Website);

3. Disclosure of Personal Information

LinkSquares will disclose personal information as authorized by you or as follows:

  • Service Providers: LinkSquares may disclose personal information to LinkSquares’ third-party service providers, sponsors, or presenters, such as (i) to comply with LinkSquares’ contractual obligations with you, including to process an agreement with you, (ii) to support LinkSquares Activities and LinkSquares’ websites, products and services, (iii) as part of marketing, sales, and promotional activities, and any other business purpose, and (iv) to manage LinkSquares’ internal operations. For example, LinkSquares may disclose your personal information to third-party service providers as part of your registration for a webinar hosted by LinkSquares or a third-party partner or to improve your experience at networking activities.
  • Partnerships: LinkSquares may disclose personal information to third-party partners, including as part of lead generation referral processes or in connection with co-marketing activities. For example, LinkSquares engages in selected business partnerships, and in such instances LinkSquares may disclose relevant information, including contact, business and usage details, to such respective third-party partners. If you directly engage with any such partner, any personal information received by such partner as part of that engagement is not covered by this Privacy Policy and you should review the third-party partner’s privacy policy.
  • Integrations: LinkSquares may integrate the LinkSquares Activities and/or LinkSquares Website with third-party service providers and LinkSquares’ products, and the provider of this third-party system may, depending on the integration, receive certain personal information from the LinkSquares Activities and/or LinkSquares Website.
  • Legal Compliance: LinkSquares may use or disclose your information (including personal information), or allow third parties to access your information (including personal information), if legally obligated to, as required to comply with applicable laws and regulations, in response to a subpoena, a search warrant or court or regulatory order (or similar requirement), lawful requests by public authorities (including to meet national security or law enforcement requirements), or other valid legal processes. Additionally, LinkSquares reserves the right to use or disclose your information (including personal information) if LinkSquares reasonably believes that such use or disclosure is necessary or useful to protect LinkSquares’ rights or property, enforce an agreement, meet LinkSquares’ contractual obligations, protect the safety of you or others, or investigate or detect fraud.
  • Professional Service Firms: LinkSquares may disclose personal information to professional service firms in connection with LinkSquares’ legal and regulatory obligations and to establish or exercise LinkSquares’ rights and defend against claims, including, for example, auditors, law firms, and consultants.
  • Affiliated Companies: LinkSquares may disclose information (including personal information) about you with LinkSquares’ Affiliates. For purposes of this Privacy Policy, “LinkSquares’ Affiliates” means any person or entity which directly or indirectly controls, is controlled by, or is under common control with LinkSquares, whether by ownership or otherwise; and “control” means possessing, directly or indirectly, the power to direct or cause the direction of the management, policies, or operations of an entity, whether through ownership of fifty percent (50%) or more of the voting securities, by contract or otherwise. Any information relating to you that LinkSquares provides to LinkSquares’ Affiliates will be treated by those LinkSquares Affiliates in accordance with the terms of this Privacy Policy.
  • Successor Organizations: Subject to applicable law, LinkSquares reserves the right to transfer some or all personal information in LinkSquares’ possession to a successor organization in the event of a merger, acquisition, bankruptcy, or other sale or transfer of all or a portion of LinkSquares’ assets. If any such transaction occurs, the purchaser will be entitled to use and disclose the personal information collected by LinkSquares in the same manner that LinkSquares is able to, and the purchaser will assume the rights and obligations regarding personal information as described in this Privacy Policy.

For the avoidance of doubt, LinkSquares may share personal data with other third parties for any other purposes where you provide your consent. Further, LinkSquares may transfer, share, or otherwise use aggregated and anonymized information that is not attributable to you in LinkSquares’ sole discretion and without the need for further consent. 4. Transfer of Your Personal Information to Other Countries

Information shared with LinkSquares, including without limitation personal information, may be transferred, processed, and stored by LinkSquares, or third parties, in the United States and other countries. If you are located outside of the United States, any information you provide to LinkSquares will be transferred to, processed, and/or maintained in the United States. If you are located outside of the United States, the transfer of personal information may be necessary to provide you with the requested information and services and/or to perform any requested transaction. By providing LinkSquares with your information, you acknowledge and consent to the transfer, processing and storage of your information across borders in accordance with applicable laws, including the transfer outside of the country of origin of your information or your country of residence. You also acknowledge and consent to the potential disclosure of such personal information as required to comply with lawful requests by public authorities, including to meet national security or law enforcement requirements. LinkSquares has implemented appropriate safeguards to protect your personal information wherever it is transferred, and LinkSquares agrees to process and disclose your personal information in accordance with this Privacy Policy and applicable law.

5. Retention of Personal Information

The length of time that LinkSquares retains information collected about you depends on the type of information and how it is collected and stored. To determine the appropriate retention period for personal information, LinkSquares considers the amount, nature, and sensitivity of that information, the potential risk of harm from unauthorized use or disclosure, the purposes for which LinkSquares processes your personal information and whether LinkSquares can achieve those purposes through other means, and the applicable legal requirements.

LinkSquares will retain your personal information for as long as necessary to fulfill the purposes for which LinkSquares collected it, in connection with the LinkSquares Activities or to provide the LinkSquares products and services, as necessary to comply with LinkSquares' legal or contractual obligations, or in connection with an actual or potential dispute (collectively, the “Retention Period”), all in accordance with LinkSquares’ data retention policy. Following this Retention Period, LinkSquares will delete the personal information or anonymize it or, if neither is reasonably feasible, isolate it from further processing (except merely storing and maintaining the security of) until it can be deleted. 6. Aggregated, De-Identified, and Anonymized Information

LinkSquares may create aggregated, de-identified, or anonymized information from personal information by removing certain data components (such as your name, email address, or linkable tracking ID) that make the data identifiable, or through aggregation, obfuscation, or other means. For example, LinkSquares may use aggregated, de-identified, or anonymized information to understand how to improve or enhance the LinkSquares Activities (including the LinkSquares Website). Subject to applicable law, LinkSquares use of such aggregated, de-identified, or anonymized information is not personal information or subject to this Privacy Policy.

7. Cookies and Similar Technologies

When you interact with LinkSquares through the LinkSquares Activities (including the LinkSquares Website), LinkSquares and LinkSquares’ partners and third-party service providers, including Google Analytics, may automatically collect certain information using tracking or similar technologies, such as cookies, web beacons, and tracking pixels. 9. Session Replay and Heatmap Technologies

LinkSquares partners with third parties to capture how you use and interact with the LinkSquares Website through behavioral metrics, heatmaps, and session replay. Website usage data is captured using first and third-party cookies and other tracking technologies to determine the popularity of products/services and online activity. Examples of the third parties LinkSquares may partner with include Microsoft Clarity and Microsoft Advertising, and for more information about how Microsoft collects and uses your data, visit the Microsoft Privacy Statement. LinkSquares does not use these technologies to collect information that is inconsistent with your intent, and LinkSquares does not use it to record sensitive information related to credit cards. LinkSquares does not provide information gathered to third parties other than LinkSquares’ service providers.

10. Chatbots

The LinkSquares Website includes certain functionality permitting you to interact with automated self-service software through a chatbot. When you interact with the chatbot on the LinkSquares Website, all the information you choose to provide to the chatbot may be collected and associated with your name or your IP address and a transcript of your interactions or communications with or through the chatbot may be created and stored. You should not enter any information into the chatbot that you would not want saved. When you communicate using the chatbot, those communications are saved in order to process your inquiries, respond to your requests, and improve LinkSquares services. By interacting with the chatbot, you are allowing your interactions with LinkSquares to be stored or analyzed, including by the chatbot provider on LinkSquares’ behalf.

11. Google Integrations

LinkSquares’ use and transfer of Google user information received from Google APIs, such as name, email, and unique Google User ID, will be in accordance with the Google API Services User Data Policy.

You may choose to stop receiving marketing and sales emails by following the unsubscribe instructions included in the emails, or you can contact us using the information in the Contact Details section. LinkSquares may continue to send you emails related to its provision of its products and/or services if you are a user of the products and/or services, or other transactional communications or legal notices, and you may not opt out of such service-related emails.

14. Additional Information for California Residents

The California Consumer Privacy Act (CCPA) gives California residents enhanced rights with respect to their personal information. Those rights are described below. In this section, “CCPA Information” refers to personal information that is linked or reasonably linkable to an identified or identifiable California resident. CCPA Information does not include de-identified or publicly available information, as defined in the CCPA.

LinkSquares is covered under the CCPA as LinkSquares collects and processes the personal information of California residents. This Privacy Policy provides the required notices to California residents. The CCPA also prohibits covered businesses from providing discriminatory treatment to California residents if they exercise their rights under the Act.

  • Access to Specific Information and Data Portability Rights: You may have the right to request that LinkSquares disclose certain information to you about our collection, use, and disclosure of your CCPA Information over the past 12 months provided that you may not make this request more than twice in a 12 month period.

LinkSquares collects and transmits your data to third-party service providers in order to deliver services to you. The CCPA requires LinkSquares to state that LinkSquares does not have actual knowledge that LinkSquares has sold or shared the CCPA Information of California residents under 16 years of age.
  • Right to Limit Use and Disclosure of Sensitive CCPA Personal Information: California residents may request that a business limit the use and disclosure of their sensitive personal information (as that term is defined under California law). How to Exercise Your California Rights

To exercise the rights described above, please contact LinkSquares using the information in the Contact Details section, and provide sufficient information and detail so LinkSquares can verify your identity and understand, evaluate, and respond to the request. Only you, or a person registered with the California Secretary of State that you authorize to act on your behalf, may make a verifiable consumer request related to your CCPA Information. LinkSquares will use CCPA Information provided as part of your request only for verification purposes.

If LinkSquares is a business with respect to your CCPA, LinkSquares will confirm receipt of your request to know, delete, or correct within 10 business days along with a description of what steps LinkSquares will take to verify and respond. LinkSquares must provide the requested information or delete your CCPA Information within 45 days of receipt of your request but can use an additional 45 days, and LinkSquares will let you know if additional time is needed.
